Service Agreement and Booking All service requests are subject to the availability of vehicles and the acceptance of the specific cargo type. A booking is considered confirmed only after the issuance of a formal consignment note or truck loading slip. Asha Logistics India reserves the right to refuse the transportation of any goods that are hazardous, illegal, or restricted under Indian law. The client is responsible for providing accurate descriptions of the weight, quantity, and nature of the goods at the time of booking.
Loading and Documentation It is the responsibility of the client to ensure that the goods are properly packed and ready for loading at the agreed-upon time. All necessary legal documentation, including E-Way bills, invoices, and permits required for interstate or intrastate movement, must be provided by the client before the vehicle departs from the origin. Asha Logistics India shall not be held liable for any delays or penalties caused by incomplete or incorrect documentation provided by the consignor or consignee.
Liability and Insurance While Asha Logistics India takes every precaution to ensure the safety of your cargo through direct point-to-point delivery and zero transshipment, our liability for any loss or damage is limited according to the Carriage by Road Act. We strongly advise all clients to secure comprehensive transit insurance for their goods. In the event of an accident or unforeseen circumstances, our liability is restricted to the terms mentioned in the specific consignment note issued at the time of loading. We are not liable for indirect losses or damages caused by delays due to traffic, weather, or government inspections.
Payment and Cancellation Payment terms must be finalized at the time of booking. Unless otherwise agreed in writing, payments are due as per the schedule mentioned in the contract. Any cancellation made after the vehicle has been positioned at the loading point may attract a detention or cancellation fee. Asha Logistics India reserves the right to withhold delivery of the goods until all outstanding freight charges and any additional expenses incurred during transit are cleared by the client.
Jurisdiction
Any disputes arising out of the services provided by Asha Logistics India shall be subject to the exclusive jurisdiction of the courts in Rudrapur, Uttarakhand. We reserve the right to modify these terms and conditions at any time without prior notice to reflect changes in law or our service policies.
